To whom it may concern.
The last day's events and Bavaria Yachtbau incredible arrogant statements, it's about time that I speak out!
I'm the owner of a Bavaria 42 Match - 'Ille Moro 1, NOR 10910.
The boat was purchased in April 2004 and cleared for sailing during May the same year.
After two months of sailing, I discovered that there was water in the bottom of the boat. There were cracks all over the area where the keel is attached to the boat.
It was pure coincident and good fortune that I did not capsize!!
I had to pull out of a race after only the first leg because of an injury to the main sail. If the sail had not broke, we would have had an upwind leg from Arendal (Norway) to Marstrand (Sweden). This is approx. 110 nm.
With wind speeds from 20 - 28 knots, it is my firm belief that the keel would have broken loose from the boat.
The representative of Bavaria in Norway (Lunde Båt AS), came immediately to the boat when I discovered the cracks.
He contacted then Bavaria Yachtbau in Germany and they had the same arrogant attitude to this damage as you encounter now!
'This was not a fault in the construction' - only a single occasion according, to Bavaria Yachtbau!!
They suggested a solution to the problem that the shipyard that was responsible for the repair job on my boat, refused to do because they thought it was not sufficient ,and would not be hold responsible for that solution.
A little background incite:
My keel had no steel plating in the bottom at all, only discs!
Bavaria Yachtbau wanted to put in those steel plates that are shown on the pictures from your boats, but the shipyard refused it as not sufficient!!!!
My boat was rebuilt in the bottom with epoxy and a brand-new attachment of the keel to the boat. A steel plating in the whole length of the keel, and an epoxy frame around the whole keel area. I think this is a temporary solution because I think the whole construction of the keel is wrong, and dangerous.
There is far too little area of the keel that is attached to the boat.
When the cracks where discovered on my boat, Lunde Båt AS contacted Rolf Breistein in Bergen, who had purchased the other Bavaria 42 Match that was delivered in Norway at this time.
He immediately discovered cracks around the keel-bolts and was ordered not to sail the boat and was offered a spare boat while his boat was repaired.
The spare boat was in Stavanger where his boat was supposed to be repaired as well. He suggested taking the 42 Match by motor from BergenStavanger to switch to the spare boat. It was the start of his summer vacation with his family.
Shortly after leaving Bergen, he took at quick peak to check the keel bolts. Then he ordered his whole family to put on the lifejackets and go on deck!
The houle [hull] had delaminated from the ribs and there was a distance of several centimeters. From the movement on the top of the bolts, he calculated that the keel was pitching more than 50 cm down in the lowest part of the keel!!!
Just a week ahead, he had sailed the Shetland race - Bergen - Shetland - Bergen, with this keel. Again just good fortune saved the crew from loss of life!!!!!
These problems are the Bavaria Yachtbau well known with and thoroughly informed about.
So when the wrote in their press release that it had to be and external event who caused the keel to fall off your yacht, it is an out right lie!!!
They knew about the weakness in the keel, but they did not say anything, and claimed that they never had heard about any weakness in the keel area at any Bavaria Yachts!!!
They can't and shall not get away with this.
You're sincerely

http://www.practical-sailor.com/editoria...ilure.html oltre Sly, Vismara
